Terms and Conditions (Terms of Service)
1. Scope
These Terms of Service apply to the use of the Clino web application (hereinafter "Service"), operated by Salvador Jovells, Loogartenstrasse 17, 8048 Zurich (hereinafter "Operator"). By registering or using the Service, you accept these Terms.
2. Description of services
Clino is a SaaS platform for private individuals who employ domestic workers. The Service includes:
- Payroll calculation (gross/net, social deductions, holiday compensation)
- Generation of payslips (PDF)
- Generation of employment contracts (PDF)
- Annual overviews and AHV registration aids for compensation offices
- Compliance reminders and deadline overview
- Insurance guidance (UVG accident insurance) with forwarding of application data at the user's request
- Referral and partner programme
- Free tools (calculators, templates, certificate)
3. No advisory service
Clino is a calculation and document generation tool. The Service does not constitute tax advice or legal advice. Clino does not broker insurance; it merely points to providers and forwards application data at the user's request. Any referral fees received are disclosed. The responsibility for correct declarations to authorities (AHV compensation office, tax authorities, accident insurance) lies solely with the employer.
4. Prices and payment
The Service costs CHF 19.90 per month. The subscription can be cancelled monthly. New subscriptions start with a free 30-day trial; no charges are incurred until it ends. In addition, a 30-day money-back guarantee applies from the first payment: upon notice to hallo@clino.ch, we will fully refund the first monthly fee. Prices are inclusive of VAT (where applicable). Price changes will be announced at least 30 days in advance.
5. User obligations
You agree to:
- Provide correct and complete information (in particular AHV numbers, wages, cantons)
- Keep your login credentials confidential
- Independently fulfil your legal obligations as an employer
- Not misuse the Service
6. Calculation accuracy
We use the official contribution rates from the BSV and cantonal compensation offices and update them annually. Despite the greatest care, we cannot guarantee the accuracy of the calculations. It is the employer's responsibility to verify the calculations.
7. Limitation of liability
The Operator's liability is limited to the subscription fees paid by the user in the last 12 months. The Operator is not liable for indirect damages, lost profits, fines, or back payments to authorities arising from the use of the Service. Mandatory statutory liability for intent and gross negligence remains reserved.
8. Data processing on behalf (data protection)
Where the user records personal data of employees in the Service, Clino processes this data as a processor within the meaning of Art. 9 nDSG, exclusively on the user's instructions and for the provision of the Service. The user confirms that they have informed the data subjects about the processing of their data. The technical and organisational measures are described in the privacy policy.
9. Data protection
Our Privacy Policy applies. The Operator processes personal data exclusively in the context of service provision and in compliance with the Swiss Data Protection Act (nDSG).
10. Termination
Either party may cancel the subscription at any time effective at the end of the current month. After cancellation, stored data will be retained in accordance with statutory retention obligations (10 years for payroll data) and subsequently deleted.
11. Changes to the Terms
The Operator reserves the right to amend these Terms at any time. Changes will be communicated by email or in-app notification and are deemed approved if the user continues to use the Service after they take effect.
12. Applicable law and jurisdiction
Swiss law applies. The exclusive place of jurisdiction is Zurich, Switzerland. Mandatory statutory places of jurisdiction remain reserved.
13. Severability clause
If any provision of these Terms is invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that most closely reflects its economic purpose.
